1. OREGON CONSUMER PRIVACY ACT (OCPA) RIGHTS

As of 2026, Oregon residents have specific rights regarding their personal and health data. We operate in compliance with ORS 646A:

  • Right to Know & Access: You may confirm if we are processing your data and obtain a copy of the specific third parties to whom we have disclosed your personal information.
  • Right to Delete & Correct: You may request that we delete data provided by or obtained about you, or correct inaccuracies in your medical profile.
  • Universal Opt-Out (New 2026): Our website honors Universal Opt-Out Preference Signals. If your browser sends a "Do Not Track" or GPC signal, we automatically opt you out of the processing of your data for targeted advertising.
  • 45-Day Response: We will respond to your data rights requests within 45 days, as required by Oregon law.

2. MANDATORY 42 CFR PART 2 ALIGNMENT (FEDERAL)

Per the February 16, 2026, federal alignment of HIPAA and 42 CFR Part 2:

  • Proceedings Protection: Any records we maintain regarding substance use disorder (SUD) carry heightened protections. These records cannot be used or disclosed in civil, criminal, administrative, or legislative proceedings against you without your specific written consent or a court order.
  • Single Consent for TPO: You may provide a single, general consent for all current and future disclosures of SUD records for Treatment, Payment, and Health Care Operations.
  • Notice of Redisclosure: Information disclosed pursuant to your authorization (especially via unencrypted email/SMS) may be subject to redisclosure by the recipient and may no longer be protected by federal or state privacy rules.

3. SENSITIVE DATA & BIOMETRICS (OREGON SPECIFIC)

Oregon law defines Sensitive Data broadly. We require your explicit opt-in before processing:

  • Biometric Data: We collect high-resolution facial photography and 3D scans ("Biometric Data") for treatment mapping. We do not sell or license this data.
  • Geolocation: We do not sell or share your precise geolocation data.

4. GOOD FAITH EXAMS & OREGON MEDICAL BOARD RULES

In accordance with the Oregon Medical Board (OMB) and Oregon Health Authority (OHA):

  • Mandatory Evaluation: Before any medical treatment (Botox, Fillers, Lasers), you must receive a Good Faith Exam (GFE) from a physician, NP, or PA. In Oregon, estheticians and RNs cannot independently establish the patient-provider relationship or prescribe medical treatments.
  • Advanced Esthetics: Procedures using high-energy devices are performed by Certified Advanced Estheticians (CAEs) or licensed medical staff under the direction of our Medical Director.

5. DIGITAL MARKETING & ADVERTISING SAFETY

  • Fair Balance: All advertising for prescription treatments (e.g., Botox®) includes mandatory safety risks.
  • Unretouched Imagery: Per FTC and Oregon consumer protection standards, "Before & After" images represent individual results and are not a guarantee of outcome.
